In these Terms & Conditions TigerBlu Events is hereinafter called the DISCO and you, the person or entity hiring the DISCO are hereinafter referred to as the PROMOTER. The PROMOTER engages the DISCO, and the DISCO accepts the engagement to appear at the venue on the date and at the times and for the fee as shown in the Provisional Booking Forum subject to these Terms & Conditions. For the purposes of this Document the DJ shall be any member of staff from the DISCO, or their appointed representative. The VENUE is any place where the DISCO is required to provide entertainment.

Payment
A non-refundable booking deposit, of the amount specified in the Provisional Booking Form, must be submitted with the signed copy of the Provisional Booking Form. A deposit returned without a signed booking form will be deemed as acceptance of these Terms & Conditions. The balance of the booking fee – as specified on the Provisional Booking Form – should be paid in cash or cheques on the day of the event and prior to the event starting. (Cheques should be  made payable to Mr M Whiteman)

 

For Corporate customers a deposit is still required and invoicing / payment terms will be defined prior to issuing a contract.


Performance Duration

The total fee quoted is in respect of a performance during the times specified in the Provisional Booking Form. If the PROMOTER requests that the performance time be extended, then the following fees will apply in cash prior to the start of the performance extension. The DISCO will require agreement from the VENUE operator or their appointed representative before the extended period can start.

 

From 12:00am until 1.00am to be charged at £80 / hour

From 1:00am until 2.00am to be charged at £120 / hour

From 2:00am until 3:00am to be charged at £160 / hour

 

Cancellation

In the event of cancellation of the engagement by the PROMOTER, a cancellation fee will be made on the following basis:

 

Cancellation advised in writing 360 days or more prior to the event date – 20% of total charge will be due (minimum of £150).
 

Cancellation advised in writing between 90 & 180 days prior to the event date – 50% of total charge will be due (minimum of £150).

 

Cancellation advised in writing 90 days or less prior to the event date – Event booking payment will be due in full.
 

When a booking has been formally cancelled, and both the parties have accepted cancellation, the PROMOTER forfeits any rights to use the services of the DISCO on the date, irrespective of deposit or cancellation fees paid.

 

Siutability for purpose

The PROMOTER must ensure that the DJ has access to at least two standard 13 amp, 230 volt sockets – these should be located near to the DJ position and does NOT count the use of a power `splitter`, `multi way` socket or extension cable to get the two sockets. RCD protected sockets are the prefered option. The working position must not obstruct any emergency exit route, and must allow enough space for the DJ to operate in comfort and safety. The equipment should not be placed directly onto the dance floor to avoid vibration damage. Unless otherwise agreed the space required by the DISCO will be at leaast twelve feet wide by six feet deep (3.6m wide x 2m deep). The DISCO reserves the right to send as many, or as few staff as it deems necessary to complete a booking. The DISCO will supply sufficient music to suit the occasion; adaquate equipment for playing and amplifying recorded music; lighting and other effects to suit the occasion and venue. The DJ , who may decide to take requests, will decide the choice of music played by the DISCO. Any music chosen before the event will be played in accordance with the PROMOTERS requirements. The choice of music played may not be cited as a reason for any problems at the event, or as reason to withhold any payment or request a refund.

 

Safety and Security

The PROMOTER is responsible for the behavior of his / her clients or guests, and for the safeguarding of the DJ and equipment (whether property of the DISCO or hired) against theft, damage or other risks, from the moment of arrival to the moment of final departure. Please note any loss of or damage to equipment, other than that caused by fair wear and tear, will be charged for.

 

Should the DJ be threatended, either verbally or physically, they reserve the right to terminate the entertainment and still receive full payment. All threats will be taken seriously and reported to the police if deemed necessary.

 

The DISCO cannot be held responsible for the way some people may be affected by strobe lighting or any other lighting, sound or haze effects may be used. The PROMOTER must advise the DJ prior to the start of the performance if any effects should be avoided.

 

Responsibilities

The DJ provided would generally be an employee of TigerBlu Events, or a self employed DJ working exclusivelty for TigerBlu Events. The DISCO reserves the right however to assign the engagement to a suitably experienced and qualified associate.

 

The DJ shall be deemed to be under the direction and control of the PROMOTER, and shall be regarded as a servant or agent of the PROMOTER, and the PROMOTER shall be responsible for any claims arising from the placement or operation of equipment.

 

The PROMOTER will be responsible for obtaining all necessary licences and permissions relating to the performance at the event.

 

For events over four hours, if you are providing food for your guests, we would also ask that you provide something for the Staff from the DISCO. If this is not possible or practical, you should inform the DISCO prior to the event and alert the venue that external food will be brought in. You are under no obligation to provide drinks for the DISCO, although a drinking water supply should be available.

 

Termination

The DISCO operates regularly serviced and maintained good quality sound and lighting equipment. Additionally, backups are carried for some equipment, however in the rare event of any equipment failure, an on site repair will be attempted. If however there is an irreparable breakdown in lighting or sound a partial refund may be given. (This is dependant on time left). This does not cover blown bulbs or fuses.

 

The DISCO shall be entitled to terminate this contract without liability if for any reason beyond its control the DISCO is unable to perform, due to fire or theft of equipment, illness or breakdown of vehicle. The DISCO will use all reasonable endeavours to locate a replacement, but, in the unlikely event of a non performance all refundable monies paid will be refunded, (non refundable deposits are not refundable in any situation) but this will be the limit of our liability to you. Should it be found on arrival, that a particular venue is not fit for the purpose or does not comply with Health and Safety requirements, the DISCO may refuse to provide their services for that event, and still require payment in full.

 

Childrens Parties / Events

The PROMOTER will provide adequate adult supervision of the children attending the event.The supervising adults will provide the DJ with assistance in the organisation of the children during any games played at the event. The supervising adults will ensure that the children do not interfere with the DISCO equipment or prevent the DJ from performing his duties of playing music and organising games (if required) Any breach of these conditions may result in the DJ ceasing performance before the allotted time without recompense to the PROMOTER.

 

Law of Contract
English Law shall govern the performance; validity, construction and all other aspects of the order and the parties agree to submit to exclusive jurisdiction of the English Courts.
